In 1991, Arthur Birnbaum was appointed as a Judge of the Housing Court and in 1996 was elected Judge of the Civil Court.

Prior to ascending to the bench in 1991, Judge Birnbaum was a Law Assistant to the Appellate Division Second Department, where he assisted in the founding of the Civil Appeals Management Program (CAMP),
in which he served with the first Judges of the Appellate Division in that capacity.

Upon leaving the Second Department in 1976, Judge Birnbaum was a litigator with Demov Morris Levin & Shein, a Manhattan real estate litigation & development firm. From 1982 to 1990 Judge Birnbaum engaged
in real estate litigation as a partner in Goldberg and Birnbaum, in which he represented, among others, Helmsley Spear entities. Judge Birnbaum has lectured at the Rent Stabilization Association and the Brooklyn Bar Association, which published his remarks in the Brooklyn Barrister (34 Brooklyn Barr. 63[1983]).
